A lawsuit is a civil action brought before a court in which a party commencing the action, the plaintiff, seeks a legal remedy. Often, one or more defendants are required to answer a plaintiff's complaint. If the plaintiff is successful, judgment will be given in the plaintiff's favour, and a range of court orders may be issued to enforce a right, impose a penalty, award damages, impose an injunction to prevent an act or compel an act, or to obtain a declaratory judgment to prevent future legal disputes.

It usually involves dispute resolution of private law issues between individuals, business entities or non-profit organizations. However, it can involve public law issues in those jurisdictions to enable the government to be treated as if it were a private party in a lawsuit, or to provide the government with a civil cause of action to enforce certain laws rather than criminal prosecution. The conduct of a lawsuit is litigation.

In the USA Frivolous litigation is a legal claim or defense presented even though the party and the party's legal counsel had reason to know the claim or defence had no merit. A claim or "defense" may be frivolous because it had no underlying justification, or because it was not presented with an argument for a reasonable extension or reinterpretation of the law.

Rules of civil procedure govern the conduct of a lawsuit in the common law adversarial system of dispute resolution.

A civil trial is a trial between private parties carried out to resolve a dispute between the parties. The term is distinguished from criminal trials, in which the government is seeking to punish an accused person for a violation of the law. A government entity can sue or be sued as a party in a civil trial, but has no greater rights than any other private party.

Most frequently, civil trials are brought to resolve questions arising under the law of contract, tort, and property. Each party will present evidence in support of their position, and a finder of fact - either a judge in the case of a bench trial, or a jury in the case of a jury trial - will render a decision as to whose rights have been violated. When the jury makes a decision, it is either liable or not liable. Most civil trials result in a cash award to a prevailing party, designed to restore a party to the position they would have been in but for the wrong that sparked the litigation.
