Immigration to Canada


Immigration to Canada is a process where people migrate to Canada and become nationals of the nation. As Canada is quite a new country, a formal immigration process has not been around for long. Nevertheless, people have been migrating to the geographic region of Canada for thousands of years, patterns varying. From the very beginning of the country in 1867 up until 1947, immigration was largely matter of British control, as all citizens of Canada were also British subjects. After 1947 domestic immigration law went through many major changes, most notably with the Immigration Act, 1976 and the current Immigration and Refugee Protection Act from 2002.

There are three main immigration categories:

Economic immigrants: Traditional form of immigration for those seeking work in Canada.
Family class: Under a government program, both citizens and permanent residents can sponsor a family members to immigrate to Canada. While this program has proven to be popular with recent immigrants, it has also been criticized by some for being open ended. This category of immigrants also has a much lower labour force participation rate than economic immigrants.
Refugees: Immigration of refugees and those in need of protection. This immigrant population has a high unemployment record (51% in 2001) of an already small labour participation rate (44 per cent ), resulting in extended financial dependence on government assistance for the vast majority of refugees.

Canada is known as a country with a broad immigration policy which is reflected in Canada ethnic diversity. According to the 2001 census by Statcan Canada has 34 ethnic groups with at least one hundred thousand members each, and numerous others represented in smaller amounts. 13.4% of the population belonged to visible minorities: most numerous among these are Chinese (3.5% of the population), South Asian (3.1%), Black (2.2%), and Filipino (1.0%).

The Immigration and Refugee Board of Canada (IRB) is an independent administrative tribunal. The IRB is responsible for applying the Canadian federal Immigration and Refugee Protection Act and for making decisions on immigration and refugee matters. The IRB decides, among other responsibilities, who needs refugee protection among the thousands of claimants who come to Canada annually. The IRB reports to the Canadian government through the Minister of Citizenship and Immigration. The operations are overseen by the chairperson, currently Jean-Guy Fleury (appointed November 29, 2002 and Marilyn Stuart-Major as Executive Director. The IRB consists of four divisions or tribunals; Refugee Protection Division; Immigration Division; Immigration Appeal Division; Refugee Appeal Division:

Immigration and Refugee Protection Act is an Act of the Parliament of Canada, passed in 2002, which replaces the Immigration Act of 1976 as the primary federal legislation regulating Immigration in Canada. The Immigration and Refugee Protection Act or IRPA as it is referred to by Canadian Immigration Consulting Professionals and lawyers creates a high level framework detailing the goals and guidelines the Canadian government has set with regards to immigration into Canada by foreign residents. The Immigration and Refugree Protection Regulations or IRPR contain the laws created to fit within the IRPA in order to speficy how the IRPA is to be applied.

Canada, is the world's second largest country by area, occupying most of northern North America. Extending from the Atlantic Ocean to the Pacific and north ward into the Arctic, Canada shares land borders with the USA to the south and to the north west. Population - July 2006 est. 32,547,200. Citizenship and Immigration Canada is the department of the government of Canada with responsibility for issues dealing with immigration and citizenship. The department was established in 1994 following a reorganization within the federal government.

CIC operates a large network of "Citizenship and Immigration Centres" throughout Canada and in an important number of embassies, high commissions and consulates abroad. Service Canada recently started to take over some of the domestic field operations of the department while the Canada Border Services Agency took over the control of enforcement and entry control at borders and airports.

CIC remains responsible for the establishment of policies and processing of permanent and temporary residence visa, refugee protection and citizenship applications.

In 2001 the Canadian Government announced changes to its immigration policy that could affect hundreds of thousands of would-be immigrants. The new rules for people applying as skilled workers will make it much harder to qualify for Canadian citizenship. The regulations, which were unveiled this week, are retroactive and will also apply to people who have already applied to immigrate to Canada.

In 2006 the Canadian government has officially apologised to thousands of Chinese immigrants charged a special tax when they arrived in the early 20th century. The government will also pay surviving immigrants and their immediate families $18,000 (£8,850) in compensation. Some surviving taxpayers say they are delighted the country has finally admitted its errors.
